Avoiding Wills being contested

A carefully drafted Will with expert legal advice could reduce the potential risk of anyone making challenges in respect of your Will.

Factors to consider:

  • If you are making your own Will, make sue that they comply with the formalities of a Will. If in doubt, make sure that the Will is checked by a legal expert in Will writing.
  • If you have not included someone in a Will, but you know that they may later make a claim, avoid this from the start. Perhaps make a legacy to them, or prepare a statement to give your reasons why you have not included this person in your Will.
  • If you are in hospital when making your Will, it would be an idea to have a Doctor witness your Will. This may ensure that any challenges on the basis of lack of capacity would be weakened.
  • Making sure that your Will is up to date avoids doubts and ensures that your last wishes are accurately noted particularly if there have been significant changes in your life.
