Disputing validity of a Will
Contesting a legal document is a complicated process but can be done.
There are many reasons a person would dispute the validity of a Will and the following are but a few examples:-
- The deceased was not mentally capable of making the Will;
- The Will was not witnessed properly;
- The Will is missing key features;
- The Clauses of the Will are contradictory;
- The contents of the Will were clearly contrary to the views of the deceased;
- The Will may be unclear or inconsistent; and
- Insufficient or no provision was made for a dependant which is contrary to the indications given to the beneficiary whilst the deceased was alive.
Before contesting a Will you should always bare in mind the result you hope to achieve as you may find that the cost of pursuing such an action far outweighs the gain to be made.
